흔히 대마초라고 하는 마리화나(Marijuana)는 마약이다. 아니다. 의견이 분분하지만 필리핀에선 대마초도 엄연히 마약(Dangerous
Drugs)로 분류되어 사용은 물론 그냥 소지만 하고 있다가 적발되면 최고 사형까지 될 수가 있으니 마약에 대해 엄격한 필리핀이나 말레이시아,
싱가폴 등지에선 아예 마약으로 의심될만한 것은 아예 휴대를 하지 않는 것이 좋습니다.
필리핀의 '마약법'이라고 할 수 있는 'REPUBLIC ACT NO. 9165'에는 아래와 같은 규정이 있으니 참고로 하시기 바랍니다.
SEC. 3. Definitions. – As used in this Act, the following terms shall mean:
v) Cannabis or commonly known as “Marijuana” or “Indian Hemp” or by its any other name. – Embraces every kind, class, genus, or specie of the plant Cannabis sativa L. including, but not limited to, Cannabis americana, hashish, bhang, guaza, churrus and ganjab, and embraces every kind, class and character of marijuana, whether dried or fresh and flowering, flowering or fruiting tops, or any part or portion of the plant and seeds thereof, and all its geographic varieties, whether as a reefer, resin, extract, tincture or in any form whatsoever.
SEC. 11. Possession of Dangerous Drugs. – The penalty of life imprisonment to death and a fine ranging from Five hundred thousand pesos (P500,000.00) to Ten million pesos (P10,000,000.00) shall be imposed upon any person, who, unless authorized by law, shall possess any dangerous drug in the following quantities, regardless of the degree of purity thereof:
위 법조문중 제3조(SEC. 3)에 “Marijuana” 또는 비슷한 이름의 식물의 말린 것, 생 것, 꽃, 심지어 씨앗까지도 마약으로 분류가 되며,
제11조(SEC. 11)에선 소지하고 있다가 받는 처벌조항인데 최고 사형 또는 50만페소(약천만원)내지 천만페소(약2억원)의 벌금을 매기도록 규정이 되어 있습니다.
참고삼아서 필리핀에서 입국할 때 누구가 쓰게 되어 있는 필리핀 입국신고서 하단에는 '마약을 소지하다가 적발되면 사형'이란 경고 문구가 들어 있습니다.
